Probate Records of John S. Tharp
of Marshall County, Indiana

John S. Tharp died in Marshall County, Indiana on July 16, 1854, shortly after moving there from Ross or Marion County, Ohio. Because he died without a will, the county commissioners in Marshall gave two-thirds of the land to the children and one-third to their stepmother, Alice.

A dispute arose after Alice sold her share. The children went to court saying that she had the right to use, but not sell the land and that it should have reverted to them after her death. The suit drug on for several years, reaching the Indiana Supreme Court, and was eventually settled in the children's favor.    

The Alexander Tharp on the plat map was John's younger brother.

Before me Richard Corbaley Clerk of the Common Pleas Court of said County this day personally came William Hatfield and being by me duly sworn upon his oath says that John S. Tharp died intestate on or about the 16th day of July AD 1854 leaving personal property to be administered upon to the probable value of Four hundred Dollars. Said decedent also died seized of Real Estate. And further that there has been no administration had upon said Estate all of which is true as I verily believe so help me God.
