Joseph Tharp Made Guardian of Brothers
in Ross County, Ohio

December 22, 1858

Joseph, age 23, informs the court of the assets of his younger brothers John and George. No mention is made of Newton who would turn 21 in a few months (March 6, 1859).

To the Probate Judge of Ross County

The undersigned would represent to the Court that John O. Tharp aged seventeen on the 16th August 1858 and George W. Tharp aged sixteen on the 2nd day of August 1858 minors and legal representatives of John S. Tharp and Elizabeth Tharp both deceased and that said minors are residing in this County. That said minors are entitled to two undivided fifths of one hundred and fifty two acres a fractional of land situate in Ross County Ohio and also two undivided fifths of a tract of land situate in Marshall County Indiana consisting of Eighty acres -- That the two undivided fifths of the land lying in Ross County as such will yield a yearly rent of about Forty Dollars that the land in Indiana being in a great degree unimproved land and a lien upon it there will not be realized any thing more than taxes and expenses from it. The probable value of the two undivided fifths of the real estate in this County will be about Sixteen Hundred Dollars and the probable value of the two undivided fifths of land in Indiana will not exceed Two Hundred dollars and that they will receive as I have been informed and believe about One Hundred and ninety four dollars from the Guardian and other sources.

After being under the guardianship of Jacob Cryder for three years, George (15), and John (16), choose their older brother Joseph as the guardian of their property.

Know all Men by these Presents, That we Joseph W. Tharp, Albert Dunlap and Herman Richart all of Ross county, and State of Ohio are held and firmly bound unto the State of Ohio, in the penal sum of Five Hundred dollars, current money, to the payment of which well and truly to be made to the State of Ohio, WE bind ourselves, our heirs, executors and administrators jointly and severally, firmly by these presents.

Sealed with our seals, and dated this 27th day of December 1858

WHEREAS: John O Tharp aged sixteen years on the 16th day of August 1858 with the consent of the Probate Court for the County of Ross and State of Ohio made choice of Joseph W. Tharp as his Guardian -- the said John O. Tharp being a minor and legal representative of John S. Tharp deceased.

Now the condition of the above obligation, is such, That if the above bound Joseph W. Tharp Guardian, as aforesaid, will render an accurate statement of his transactions, with a just account of the profits arising from the estate of said minor and deliver up the same to the Court, at such time as they may require, and discharge with fidelity the trust reposed in him then this obligation to be void, otherwise to remain in full force and virtue.
