Know all men by these presents that Joseph W. Tharp, Herman Richart and Mary Ann Richart wife of the said Herman Richart (late Mary Ann Tharp) of county of Ross in the State of Ohio in consideration of the sum of one thousand six hundred dollars in hand paid by James Little of the county and state aforesaid have bargained, and sold, and do hereby grant, bargain, sell and convey unto the said James Little, and his heirs and assigns forever the interest of the said grantors in and to the following premises being the undivided two fifths parts thereof situate in the County Ross and State of Ohio and described as follows to wit the South East quarter of Section number thirty three, in Township nine of Range No. Twenty one (Worthington's Survey) in the district of Lands directed to be sold at Chillicothe in the State of Ohio by act of Congress being Lands patented by the United States to Frederick Overley who devised the same to his Daughter Elizabeth (late Elizabeth Tharp) and her children and heirs, and the said Elizabeth having died leaving five children of whom the said Joseph W. Tharp and Mary Ann Richart are two and therefore entitled to two fifths of the premises aforesaid and which said two fifths is hereby intended to be conveyed to have and to hold the said undivided two fifths parts of said premises with the appurtenances unto the said James Little and to his heirs and assigns forever and the said Grantors Joseph W. Tharp, Herman Richart, and his wife, Mary Ann Richart for themselves and their heirs do hereby covenant with the said James Little and his heirs and assigns that they lawfully seized of said undivided two fifths of said premises that the same are free and clear from all encumbrances whatsoever and that they will forever warrant and defend their respective interest in said premises with the appurtenances against lawful claims of all persons whomever. In testimony whereof the said Joseph W. Tharp and the said Herman Richart, and Mary Ann Richart, his wife have hereunto set their hands and seals - this third day of December AD 1855.

The State of Ohio, Ross County

Before the undersigned a Justice of the peace in and for said County of Ross personally appeared the above named Joseph W. Tharp, Herman Richart, and Mary Ann Richart his wife, and acknowledged the signing and sealing of the foregoing deed of conveyance to be their voluntary act and deed and the said Mary Ann Richart, wife of the said Herman Richart, being at the same time examined by me separate and apart from her said husband and the contents of said instrument made known to her by me she then declared that she did voluntarily sign, seal, and acknowledge the same and that she is still satisfied therewith this third day of December A.D. 1855.
