James Lolley Deed

Susannah and her son George sell their share of the family property in Ontario, Wayne, New York to her son James. Susannah provides a mortgage to help him with the purchase.

This Indenture made the seventh day of May in the year one thousand eight hundred and fifty seven between George Lolly and Susannah Lolly widow of the late William Lolly deceased of the Town of Ontario Wayne and State of New York of the first part and James Lolly of the Town, County, and State aforesaid of the second part.

Witnesseth that the said parties of the first part for and in consideration of the sum of two hundred and forty dollars [$240.00] to them in hand paid by the said party of the second part, the receipt whereof is hereby acknowledged have remised, released, and quit claimed and by these presents do remise, release, and quit claim unto the said party of the second part and to his heirs and assigns forever all that certain piece or parcel of land situate in the Town of Ontario in the County of Wayne and state of New York, known and distinguised as the North part of Lot number forty three in the east division of Township number fourteen in the third range of Townships and bounded as follows.

Beginning at the Northeast corner of said Lot; thence South four degrees west, forty five rods; thence north eighty six degrees west fifty rods; thence north four degrees east forty five rods; thence South eighty six degrees east fifty rods to the place of beginning. Containing 14 acres and ten rods as surveyed by E. Davis October 28th 1850 be the same more or less. Together with all and singular the tenements, hereditaments and appurtenances thereunto belonging and also all the estate right, title, interest, dower, and right of dower of the parties of the first part.

In witness whereof the said parties of the first part have hereunto set their hands and seals the day and year first above written.

James Lolley Mortgage

Through a mortgage from his mother, Susannah Lolley, James buys the family property in Ontario, Wayne, New York.

This indenture made this seventh of May in the year of our Lord one thousand eight hundred and fifty seven Between James Lolly of the town of Ontario county of Wayne and State of New York of the first part and Susannah Lolly of the same county and state aforesaid of the second part.

Witnesseth. That the said party of the first part in consideration of the sum of five hundred dollars [$500.00] has sold and by these presents does grant and convey to the said party of the second part his heirs and assignees all that tract or parcel of land situate in the town of Ontario in the county of Wayne and State of New York known and distinguished as the north part of lot number forty three in the east division of township number fourteen in the third range of townships and bounded as follows.

Beginning at the north east corner of said lot, thence south four degrees west forty five rods, thence north eight six degrees west fifty rods, thence north four degrees east forty five rods, thence south eighty six degrees east fifty rods to the place of beginning containing fourteen acres and ten rods as surveyed by E. Davis October 28th, 1850 be the same more or less.

This grant is intended as a security for the payment of the sum of two hundred dollars [$200.00] and interest from the date hereof on the first day of November next and this conveyance shall be void if such payment be made as herein specified. And in case default shall be made in the payment of the principal sum hereby intended to be received or in the payment of the interest thereof or any part of such principal or interest as above provided, it shall be lawful for the party of the second part her executors, administrators, assigns etc any time thereafter to sell the premises hereby granted or any part thereof in the manner prescribed by my hand, and out of all the moneys arising from such sale to retain the amount then thus due for principal and interest together with costs and charges of making such sale, and the surplus if any there be shall be paid by the party making such sale on demand to the said James Lolley heirs or assigns.
