Declaration for Original Invalid Pension

On this 23rd day of June, A.D. one thousand eight hundred and eighty personally appeared before me clerk of the Circuit Court, a court of record within and for the County and State aforesaid, John W. Lolley, age 48 years, a resident of Leghorn, County of Pottawatomie, State of Kansas, who being duly sworn according to law, declares that he is the identical John W. Lolley who entered service under the name of John W. Lolley on or about the 29th day of February 1864 as Private in company H. of the 36th regiment of Wisconsin Infantry Volunteers commanded by Austin Cannon and was discharged at Jeffersonville on or about the 12th day of July 1865 by reason of close of the war that his personal description is as follows: Age 48 years; height 5 feet 10 inches; complexion, Sandy; hair, Black; eyes, Blue. That while a member of the organization aforesaid in the service and in the line of his duty at Deep Bottom, in the State of Virginia, on or about the 14th day of Aug 1864 he received a sun stroke affecting his heart and breast near Petersburg, Virginia. 1864 he contracted chronic diarrhea caused by exposure and army diet.

That he was treated in hospitals as follows: Was taken to Hospital City 1st Va. Aug 15 - 1864 and remained two weeks and was then sent to Hospital at Washington D.C. remained there until February 1865.

That he has never been employed in the military or naval service otherwise than as stated above. That since the 12th day of July, A.D. 1865 he has not been employed in the military or naval service of the United Sates. That since leaving the service this applicant has resided in the States of Wisconsin & Missouri & Minnesota and in the State of Kansas and his occupation has been that of a Farmer. That prior to his entry into the service above named he was a man of good, sound, physical health being when enrolled a Farmer. That is now partially disabled from obtaining his subsistence by manual labor by reason of his injuries above described, received in the service of the United States; and he therefore makes this declaration for the purpose of being placed on the invalid pension roll of the United States.

He hereby appoints with full power of substitution and revocation, George E. Lemon of Washington D.C. his true and lawful Attorney, to prosecute his claim. That he has never received nor applied for a pension. That his post office address is Leghorn county of Pottawatomie, State of Kansas.

Lolley the claimant sign his name to the foregoing declaration; that they have every reason to believe, from the appearance of said claimant and their acquaintance with him that he is the identical person he represents himself to be; and that they have no interest in the prosecution of this claim.

Personally came before me a Justice of the Peace in and for aforesaid county and State, Claiborne Stone, E.S. McMurry, John McGregor, and Benjamin Reeves persons of lawful age, who, being duly sworn, declare in relation to the aforesaid case as follows:

21. The following is my explanation of testimony above given and it is the design of the above applicants to include this explanation in their testimony. Claiborne Stone has lived from forty rods to three miles distant from claimant most of the time one and one half mile and was formerly a farmer. Now runs a general assortment store.

John McGregor and Benjamin Reeves did not hear remarks of attending doctors.

In the matter of the Pension Claim of John W. Lolley.

Personally came before me a Notary Public in and for aforesaid County and State, John W. Lolley a person of lawful age, who being duly sworn, declare in relation to the aforesaid case as follows:

that he is the identical John W. Lolley who served as a private in Co. H. 36 Wisconsin Vol. Inft. that on or about the 14th July 1864 he was attacked with the chronic diarrhea disqualifying him from duty a part of the time and continuing in that condition until his discharge, and on or about the 14th day of August 1864 he was sun struck while in the line of duty at Deep Bottom, Virginia was stricken down, taken up, and removed to ambulance and taken to Hospital first in Camp Hospital thence to City Point and from there to Washington. He does not remember what class of hospital he was first taken to on account of the insensible state he was in and remained in the second hospital for seven months and then returned to duty but suffered from the effect more or less during the remainder of his service and has suffered all the time since his discharge from said service and am now suffering from the same and am not able to perform more than half manual labor and can not do even that much without suffering caused by army diet and exposure.

Respectfully returned to the Commissioner of Pensions. John W. Lolley, a private of Company H. 36th Regiment Wisconsin Volunteers, was enrolled on the 29th day of February, 1864 at Oxford, for 3 years, and is reported on muster rolls of Co. to June 30, 1864 present. July and Aug. 1864 absent, sick in the hospital since Aug. 20/64 and same to Dec. 31, 1864. Jan. and Feb. 1865 present and same to June 30, 1865. Mustered out with Co. July 12, 1865 at Jeffersonville, Indiana.

Muster roll of Co. H for May and June 1864 reports Archibald Crane Corporal, absent sick since June 20/64 and same to Aug. 31, 1864.

Regimental return from June 1864 reports C.E. Warren, Major present.

Muster roll of Field and Staff for July and August 1864 reports him Lieut. Col., absent wounded at Deep Bottom, Virginia, Aug. 14, 1864 where regiment was in action. Regimental return for July 1864 not on file. No evidence that he was Colonel of above regiment.

Name Charles Demot is not borne in the rolls of Co. H 36th Wisconsin Vols. on file in this office.

Nature of sickness not stated. The records of this office do not show disabilities alleged. Regimental Hospital Record or Company.

In the matter of the pension claim of John W. Lolley late of Co. H 36 Wis. Vol. Personally came before me a Justice of the Peace in and for aforesaid County and State, Alpheus L. Smith and Arminda Smith his wife. Alpheus L. Smith is 47 years of age and Arminda Smith is 47 years of age and their post office address is Humbird, Clark County, Wisconsin persons of lawful age, who, being duly sworn, declare in relation to the aforesaid case as follows:

Our first acquaintance with John W. Lolley was in the year 1865. He came to my house in Nashville, Martin Co., Minnesota and was sick. It was in the month of August. His wife came with him and his boy to take care of his team. He said he was just discharged from the United States service.

In a few days he was taken worse and was confined to his bed. He complained of violent pain in his head and breast. Doctor Lockwood was employed to doctor him. He remained very sick for a long time. His wife stayed with him until she was obliged to return back to Wisconsin to her family while he remained sick at my house, and my wife Arminda Smith took care of him until his wife returned.

I went back to Wisconsin with his wife and moved his family to him in Minnesota. When I returned he was able to be up and walk around, but was not able to do any labor. He lived four miles from my place the fall of 1865 and that winter I saw him as often as three and four times a month during that fall and winter. He did not do any manual labor during that time.

The next summer he moved within one mile and a half of my place. In 1866 I saw him oftener, sometimes twice a week. He did some labor but not to exceed 1/4 that an able bodied man would do that summer.

I was acquainted with John W. Lolley from August 1865 until October 1866. During that time he would often be sick a week at a time confined to the house with the same disease he had when he came to my place. Dr. Lockwood the doctor that doctored him while in Minnesota told me that his disease was caused by overheating himself and his health was broke down by the hardships of the service. Doctor Lockwood that doctored John W. Lolley while in Minnesota is dead and has been for several years. I was personally acquainted with John W. Lolley until he left Minnesota as Doctor Lockwood recommended going south for his health and he did.

We further declare that we have no interest in said case, and are not concerned in its prosecution.

In the matter of pension claim no 399482 of John W. Lolley late private Co. H 36 Wis. Infnt. Personally appeared before me John W. Lolley applicant and being first duly sworn according to law says that his post office address is Leghorn, Pottawatomie County, Kansas and that he was treated by Dr. Rigstall of Chappel Hill, Johnson Co., Missouri and Dr. Lockwood of Winnebago City of Blue Earth Co., Minnesota and that he was treated by no others until treated by Dr. O.C. Aytell of Westmoreland, Pottawatomie County, Kansas in 1873. Dr. Lockwood is dead and I have no knowledge of Dr. Rigstall and am unable to get his certificates.

In the matter of the Pension Claim of John W. Lolley. Personally came before me a Justice of the Peace in and for aforesaid county and state William Fowler whose age is 71 years residence Barton County, Missouri and P.O. address is Lamar, Barton County, Missouri person of lawful age, who, being duly sworn, declare in relation to the aforesaid case as follows:

That I have been acquainted with said John W. Lolley before he enlisted and knew him to be a stout and able bodied man before he enlisted and that I have known him since the war while he lived here in Missouri in the fall of 1866 and he was not able to do more than 2/3 of an able bodied man for a pain in his head and breast and he was troubled with the chronic diarrhea. And in 1867 he was about the same able to do about 2/3 of an able bodied man and in 1868 he was not quite so bad. I think that he was able to do about 3/4 the work of an able bodied man and in 1869 he was about the same as in sixty eight, able to do 3/4 the work of an able bodied man and in 1870 he moved to Kansas where he now lives.

I make this statement of my own knowledge for I have worked with him and for him and he for me. I have eaten with him and slept with him and taken care of him. He told me that it was caused by a sunstroke which he received while in the late war or rebellion.

I further declare that I have no interest in said case, and am not concerned in its prosecution.
