Robert Oliver Made Guardian of Tharp Boys
in Ross County, Ohio
February 15 - March 15, 1862
After three years under the guardianship of their older brother Joseph Tharp, 18-year-old George and 20-year-old John choose Robert Oliver as the guardian of their property. Robert Oliver was the brother of Eliza Jane Oliver who is married to the boys uncle Fred Overly. George and John likely switched guardianship at this late date because Joseph and Amanda, who were married in 1860, were planning on leaving Ross County.
Know all Men by these Presents, That we Robert Oliver, Henry Oliver and William Ashworth all of Ross County, and State of Ohio, are held and firmly bound unto the State of Ohio, in the penal sum of Five Hundred Dollars, current money, to the payment of which well and truly to be made to the State of Ohio, we bind ourselves, our heirs, executors and administrators, jointly and severally, firmly by these presents.
SEALED with our seals, and dated this 15 day of February 1862
Whereas, the Probate court in and for the county of Ross and State of Ohio has this day appointed Robert Oliver guardian of George W. Tharp who is a minor and legal representative of John S. Tharp deceased.
Now the Condition of the above Obligation is such, That if the above bound Robert Oliver Guardian, as aforesaid, will render an accurate statement of his transactions, with a just account of the profits arising from the real and personal estate of said George W. Tharp and deliver up the same to the Court, at such time as they may require, and discharge with fidelity the duties devolving up him by law as such Guardian, then this obligation to be void, otherwise to remain in full force and virtue.

To the Probate Judge of Ross County:
The undersigned states that John O. Tharp a minor resident of the county of Ross, and legal representative of John S. Tharp deceased, that the said minor was twenty years of age on the _____ day of August last past; that said minor is entitled to personal property to the value of about one hundred twenty seven 76/100 dollars, as the undersigned has been informed and believes, and that he is seized of one undivided fifth of certain real estate containing about one hundred sixty acres, situate in Ross County, Ohio & 125 acres in the state of Indiana the annual rents and profits of said undivided fifth do not exceed the sum of Thirty dollars, and that the value of the real estate in the state of Ohio will probably amount to about Eight Hundred dollars. The undersigned has no Knowledge of the value of the real estate in the State of Indiana but has learned that the heirs estimate their shares at about one hundred dollars.
The undersigned asks that he may be appointed Guardian of the person and estate of said minor.
